Hearing postponed for alleged prowler

A preliminary hearing for an alleged prowler has been postponed in Lackawanna County Court, according to a Lackawanna County Deputy District.

David L. Yevitz, of Briar Hill Circle, was arrested on the night of Oct. 23 by South Abington Township Police. Charged with six counts of loitering and prowling at nighttime, one count of stalking, and one count of resisting arrest, Yevitz was set to appear in court on Oct. 28. However, according to Lackawanna County Deputy District Attorney Michelle Olshefski, the preliminary hearing for Yevitz has now been postponed to Dec. 7, following the filing of a request for continuance by attorneys representing Yevitz.

“The motion for a continuance is filed on behalf of the defendant by the defendant’s attorney,” Olshefski explained. “The filing postpones the date of the hearing to a later date in court.”

Yevitz was arrested on Oct. 28 by Sergeant Gregory Winowich after a suspect was spotted allegedly trespassing and peering into the windows of several homes in the vicinity of Greenbriar Drive and Briar Hill Circle. With additional police units arriving on the scene, officers began to search for the suspect, who was first encountered by Sgt. Winowich. According to Winowich, after the suspect ignored repeated commands from officers to drop to the ground, a taser was used to subdue him. He was then placed under arrest and processed.

According to Olshefski, Yevitz was serving probation at the time of his most recent arrest. He remains incarcerated in the Lackawanna County Prison.
