WILKES-BARRE – The mother of a woman who was killed after the car she was riding in struck a tree has filed a lawsuit against a city tavern, alleging employees there continued to serve alcohol to the driver even though he was visibly intoxicated.
Kathy Seeman, administrator of the estate of Amber Seeman, filed suit Thursday against The Poplar Inn, 86 Poplar St., Wilkes-Barre.
The suit, filed by attorney Jerome Gamburg of Philadelphia, claims the tavern sold alcohol to John E. Day despite the fact he was visibly intoxicated.
Day, 31, of Hunlock Creek, was charged with homicide by vehicle while driving drunk. Police said he had a blood-alcohol content of 0.16 percent – twice the legal limit – when he crashed his car into a tree on Wilkes-Barre Boulevard at New Hill Street, killing Seeman, 26.
Day pleaded guilty to the charge last year and was sentenced to three to six years in prison.
The lawsuit seeks monetary damages for Kathy Seeman, as well as her husband, James, and Amber Seeman’s daughter, Aliviah.
