A Bear Creek Township man was legally drunk when he crashed his pick-up truck head-on with a vehicle that claimed the life of a 69-year old Mountain Top man in August, authorities said.
Shane Herbert, 19, was charged with homicide by vehicle while driving under the influence for the crash on state Route 115 on Aug. 30.
Authorities said Herbert was traveling north on Route 115 and crossed into the southbound lane colliding head-on with a 1958 Cadillac, driven by Michael J. Coffee.
Coffee died on Oct. 2 at the University of Pennsylvania Hospital in Philadelphia.
Two passengers in Coffee's vehicle were injured.
Herbert will be arraigned before District Judge Michael Dotzel in Wilkes-Barre Township later today.
