According to the police report, officer Michael Marino was on routine patrol at 2:29 a.m. along the 100 block of Adams Avenue when he saw a group of men standing in the street. As he drove closer, one man, who police later identified as Nathan Smith, came out from behind the group and started running naked toward Marino’s location.

When the officer approached, Smith, who is the Penguins captain, apologized and said he acted on a bet.

Smith, 26, of Mountain Top, was charged with third-degree misdemeanor counts of indecent exposure, open lewdness, disorderly conduct and a summary offense of public drunkenness. He was released on $10,000 unsecured bail, according to Lackawanna County Court records.

Penguins forward Ryan Stone, 23, also was charged with public drunkenness when the group didn’t disperse. Stone has been with the Penguins since the 2005-06 season.

Smith, who joined the Penguins before the start of the 2007-08 season, issued the following statement on Monday:

“I would like to apologize to the people of Northeast Pennsylvania, my teammates, and to the Wilkes-Barre/Scranton and Pittsburgh Penguins organizations. I made an embarrassing and regrettable decision this weekend and understand I will face disciplinary action. My conduct was unacceptable and totally out of character – it will not happen again. I promise to do my best to win back your trust and support.”

The Penguins organization also released a statement, calling the incident “unacceptable,” and apologized to the fans and community. The organization is cooperating with authorities and will take private disciplinary action against Smith and Stone.

When asked if the players would miss any games in the upcoming second round of the playoffs, head coach Todd Richards said he won’t make a decision until he has more information. The Penguins open the second round Thursday at the Wachovia Arena.

Stone didn’t practice on Monday, but Richards said it was for physical reasons.

Smith is tentatively scheduled for a preliminary hearing for May 5, according to court records.

A conviction of a third-degree misdemeanor carries a sentence of up to a year, according to Pennsylvania sentencing guidelines.

This is a joke. Don't the Scranton police have anything better to do? I'm sure Ryan Stone wasn't the only person on the street at that time who was drunk on Saturday night.

Although very stupid, I don't believe these two should be suspended because that will hurt the other players on the team and why should they (the others) have to pay a price here. Plus, I do believe that similar situations have occurred with other players on other teams and not all have suspended the players. After all, even though irresponsible behavior was used, part of their lives are personal and should remain as such to an extent. Take away the "C" and "A", while issuing a warning for no second chances, but don't hurt the team as a whole.

Well, well, well, talk about getting caught with your pants down? Nathan Smith should be removed from the team. Don't have to wait to see if he is guilty due to the fact he admitted to his poor conduct by submitting a statement. Not a role model that I would want my children to follow. If it hurts the team so be it. This is just the reason why he should know better especially being Captain. As far as Ryan Stone. he should also be removed from the team if he is found guilty of the charges pending against him. These men should know better, and I believe the team would be better off without them. If the team decides to do nothing then we will see the whole team streaking down the streets of Scranton during the St. Patricks Day Parade. How about that?

Is Mr. Boyko serious? These are a couple of young guys that just got a little carried away. "Lighten Up Francis". There are far too many people out there doing really bad things, compared to what really amounts to what is one of the funniest stories in a long time.

I do not agree, I think they should pay the price every other citizen would pay. If it hurts the team that's on them. They should have thought about that before thay acted this way.

i'm a true fan of the pens, but that was no way to celebrate. true to what Joann stated, the team shouldn't hurt for their problem. my young generation, though doesn't see that actions have consequences, and if every celebrity or athlete gets away with murder, we'll never have good role models. they need to have a punishment of sorts, but not one that could affect the entire hardworking teams' chance at the calder cup!!!!

So as long as your going for a calder cup, let's be leanient on them. I am also a Pen's fan and we didn't give that courtesy to the Hershey player that got drunk in public. We all thought he should be off the team. I guess as long as it doesn't hurt us, then just let it slide. I'm so ashamed

I THINK THE FINE FOR WHAT MR SMITH DID IS A BIT OVERKILL. THEY ARE BOYS HAVING FUN. WHEN I WAS A KID WE ALWAYS HAD SOMEONE WHO WOULD DO SOMETHING LIKE THIS AND EVERYONE JUST LAUGHED. BOTH BOYS ARE GOOD BOYS WHO JUST DID SOMETHING BECAUSE THEY WERE UNDER THE INFLUENCE. YOU WOULD THINK THEY KILLED SOMEONE. SCRANTON POLICE NEEDS TO GET OUT AND ARREST THE DRUG DEALERS. NOT KIDS HAVING A LITTLE FUN. THE PUNISHMENT IS OUT OF LINE.

Who cares about this stuff? I personally think it is hilarious. It's called being young and having a sense of humor. I would rather my children hear about someone streaking naked in public than about how Luzerne County employees are able to steal from taxpayers.

A 26 year old CAPTAIN of the team is not a boy having fun, that is a man making a very poor choice. First of all he should have his captaincy removed. And a 23 year old assistant captain charged with public drunkenness FOR THE SECOND TIME this hockey season? Hmmm, L. BROODY, maybe the police could concentrate on arresting the drug dealers if they didn't have to keep getting the Stone BOY, as you call him, off the streets. The first time Stone did this he was suspended a game, I guess he didn't learn his lesson so let's not suspend him this time. Monday in Philly will be interesting.... And a tip to Captain Smith: If you get any jail time, don't go streaking down the cellblock!!
