WILKES-BARRE – The mother of a Mountain Top man killed when his motorcycle struck a flatbed truck that was allegedly blocking the roadway has filed a lawsuit against the driver and his employer.
Attorney Carmen Latona filed the suit in Luzerne County Court on behalf of Alma Gregorowicz, mother of Anthony W. Throop, against Rodolfo Barragan of Scranton and Robert and Kathy Rave, owners of Rave Landscaping Inc., of Dallas.
According to the suit:
On May 29, 2008, Barragan, who allegedly did not have a valid driver’s license, was operating a 1992 GMC flatbed truck owned by Rave’s and was attempting to make a right turn onto Church Road in Rice Township. Barragan was unable to make the turn and stopped the truck laterally, blocking both lanes of the roadway.
Anthony Throop, 21, was riding a 2002 Buell motorcycle east on Church Road around 2 p.m. when he came upon the stopped truck. Throop was unable to stop the motorcycle and crashed into the side of the truck, causing him to suffer fatal injuries.
The suit alleges Barragan operated the truck in a negligent manner, and that Kathy and Robert Rave were negligent for allowing a person who allegedly did not have a valid driver’s license to operate the vehicle.
The Raves did not return a phone message left at their business on Thursday.
