Kadluboski wins ruling from zoners
    The permission is contingent upon solving problems of water runoff
   
WILKES-BARRE — Despite protests by next-door neighbor and former city fire
chief Leo Ryan, the city Zoning Hearing Board on Wednesday granted towing
service operator Robert Kadluboski’s latest request to come before it.
   
Kadluboski, who formerly had the city towing contract and has had several
well-publicized run-ins with the Wilkes-Barre City Council and city officials,
scaled down a previously rejected request to build a two-story residential
garage on the rear of his property at 313 McLean St.
   
The board’s approval of the new application waives the minimum rear yard
setback and maximum building lot coverage to allow Kadluboski to build a
one-story garage. He said his neighbor to the rear wanted him to build right
on the property line, but he preferred to leave one foot of space to handle
any water runoff problems.
   
Ryan expressed concern about possible runoff problems, and board chairman
Robert Jabers told Kadluboski the approval was conditional on his making
certain that any such problems were taken care of satisfactorily.
   
A neighbor’s concern about water runoff led the board to deny Elmer
Vecchi’s application for several waivers to construct a platform addition to
his garage at 12 Knight St. Vecchi was invited to re-submit a revised request.
   
The board granted the following applications:
   
William Morio, waivers of one side yard setback and maximum building lot
coverage for installation of an above-ground swimming pool at 14 Hughes St.
   
Robert Baron, special approval to change from the nonconforming use of
video sales to another, television/VCR repairs, at 354 E. Northampton St.
   
Jeanine Wolczyk, waiver of one side yard setback for construction of a
stair and landing at the side of her house at 41-43 E. Main St.
   
Lois Sobieski, waiver of one side yard and rear yard setbacks and maximum
building lot coverage, to construct a carport at 277 Academy St. She agreed to
the board’s stipulation that the structure not be enclosed, as originally
planned.
   
Sandra Bonn, special approval to change from the nonconforming use of
office space to another, beauty salon, at 73 S. Welles St.
   
Marie Gryczko, special approval to establish a beauty salon in her home at
81 Kado St.
   
Gale McGeever, special approval to establish a reflexology practice in her
home at 336 Blackman St.
   
Mercy Hospital, waiver of maximum height and size for installation of an
illuminated wall sign at the third-story level of its south tower at 25 Church
St.
   
Ben Leggieri, special approval to change a portion of his nonconforming
grocery store to an eating and drinking establishment at 124 Grove St.
   
Ronald Kitlas, waiver of minimum lot area per unit to convert an existing
single-family house to two units at 30 Ralph St.
   
Michael Butwin, waiver of minimum lot area per unit to add a second
dwelling unit in his house at 369 E. Market St.
   
King’s College and Excalibur Development Corp., one-year temporary variance
to waive off-street parking, loading and vision obstruction requirements to
establish a temporary unimproved off-street parking area at the corner of
North and North Washington streets.
   
Jabers, a member of the Excalibur board, abstained from the vote.
