SCRANTON — A nurse’s aide originally facing state charges in connection with a theft at the Veterans Administration Hospital in Plains Township has now been charged in federal court.

Warren T. Wells, 42, of Moscow, Lackawanna County, was charged today with theft in connection with an incident at the VA hospital on Dec. 13, 2013, the U.S. Attorney’s Office for the Middle District of Pennsylvania announced.

A criminal information was filed in U.S. District Court in Scranton charging Wells with theft of a golden crucifix necklace from a patient/veteran who was being treated at the hospital, U.S. Attorney Peter J. Smith said in a news release.

Wells was originally charged by local authorities in January, but that prosecution will be withdrawn in favor of federal charge, Smith said.

The VA Hospital is a federal facility and alleged crimes on the premises are subject to prosecution in federal court, Smith said.

If convicted, Wells could be sentenced to a statutory maximum of up to five years in prison and a fine of $250,000.
