Judge rules Musto mentally incompetent

WILKES-BARRE — Former state Sen. Raphael Musto was ruled mentally incompetent to stand trial by U.S. District Court Judge A. Richard Caputo, who ordered him to a hospital for treatment.

Caputo issued the ruling late Tuesday afternoon after an all-day hearing on Monday when physicians testified that Musto is suffering from non-alcoholic cirrhosis of the liver.

Musto’s trial was scheduled to begin Monday with jury selection on public corruption related offenses.
