Scrap yard owner’s objections dismissed

A Luzerne County judge has dismissed preliminary objections by John Kocher in a lawsuit filed against Kocher by the Wilkes-Barre Area School Board.


The board is seeking to force Kocher to remove salvage vehicles it contends Kocher has put on district property in Wilkes-Barre Township. Aerial maps from Luzerne County suggest a salvage yard run by Kocher has expanded deep into a district-owned lot, but in an interview Kocher said there is no proof he has encroached over a district property line.


Kocher’s attorney filed preliminary objections contending the district had not met legal requirements in it’s lawsuit and had no legal standing to file the suit. Luzerne County Judge Fred A. Pierantoni denied and dismissed Kocher’s objections.
