NANTICOKE — Luzerne County prosecutors on Friday charged Lorenzo Burgos, 22, of Third Street, Plymouth, with an open count of criminal homicide in the death of Fred John Kleman Jr. in August.
Burgos initially was charged with vehicular homicide and involuntary manslaughter when he allegedly struck Kleman with his vehicle on Nottingham Street in Plymouth on Aug. 14.
Prosecutors withdrew the homicide by vehicle and and manslaughter charges after an inspection of Burgos’ vehicle revealed there were no problems with its brakes.
Instead of facing three years in prison, if convicted, Burgos now could face life in prison if found guilty of first-degree murder.
State police at Wyoming allege Kleman yelled at a speeding driver to slow down. The driver, identified as Burgos, drove back and struck Kleman, who died from multiple traumatic injuries, according to the Luzerne County Coroner’s Office.
Burgos was arraigned by District Judge Donald Whittaker in Nanticoke and jailed at the Luzerne County Correctional Facility without bail.
