Judge cancels jury selection after finding conflicting dates in criminal charges filed against W-B Twp. fire chief

WILKES-BARRE — Saying he had a duty to inform jurors of the charges against Wilkes-Barre Township fire chief John Yuknavich, a judge rescheduled jury selection until Sept. 2, after finding conflicting dates in the complaint filed by the district attorney’s office.

Luzerne County Judge Michael Vough ordered assistant district attorney Michael Melnick to file a motion to amend the complaint by Aug. 15. Attorney Barry Dyller, representing Yuknavich, must respond to the filing by Aug. 22.

Jury selection was scheduled to begin at 1:30 p.m. today for Yuknavich who faces four counts of theft by failure to make required disposition of funds paid by the township to the fire department. Vough noted that the alleged thefts occurred all on the same date of Feb. 11, 2008, but that the deposits dates differed by several years.

Vough said it was his responsibility to inform the jurors of the charges filed by the prosecution and would not proceed until the conflict was resolved.
