NANTICOKE – A woman and her boyfriend accused by Plymouth police of endangering two children and having heroin inside their house waived their rights to preliminary hearings Tuesday before District Judge Donald Whittaker in Nanticoke.
Nicole Ann Brown, 34, and David Staniecki Jr., 35, of Lee Street, Plymouth, waived charges of endangering the welfare of children and possession with intent to deliver a controlled substance to county court.
Police withdrew three counts of possession of drug paraphernalia and one count each of possession of a controlled substance and delivery of a controlled substance against Brown and Staniecki.
Police allege they found a large quantity of heroin, cell phones, and 16 peach-colored pills in the couple’s residence on Aug. 18, according to the criminal complaint.
An 8-month-old girl and a 2-year-old girl were in the residence that was filled with dog feces and dirty diapers, the criminal complaint says.
WILKES-BARRE – A man who police say rammed his vehicle into a Luzerne County sheriff’s cruiser after narrowly missing a deputy has appealed his sentence to the state Superior Court.
Michael Weir, 44, with a last known address of Pine Street, Wilkes-Barre, was sentenced in late July to three years and five months to seven years in state prison.
He filed papers notifying the court of his appeal on Monday through his attorney, Matthew Kelly.
Weir, 44, was sentenced by county Judge Chester Muroski on two counts of reckless endangerment and one count each of resisting arrest and aggravated assault. A county jury found Weir guilty of the charges after a one-day trial.
According to court records, on Oct. 17, the Luzerne County Sheriff’s Department was alerted that Weir, who was wanted for failure to appear at a preliminary hearing in a theft case, was moving belongings out of his son’s Pine Street apartment.
As the deputy attempted to apprehend Weir, he backed out of the driveway onto the street, causing the deputy to jump into the car to avoid being hit, according to court records. The deputy tried to shut off Weir’s vehicle and it rolled backwards, striking the cruiser with another deputy inside. Weir was then taken into custody and to the county prison.
