DA challenges flood authority board appointments

WILKES-BARRE - Luzerne County District Attorney Stefanie Salvantis today filed a court action that challenges the appointment of three members of the county??s Flood Protection Authority.

The complaint alleges the appointment of three board members - William Falls, Douglas Ayers and Kevin O??Brien, was not in accordance with the Flood Authority??s articles of incorporation and/or the county??s charter.

In a press release, Salvantis emphasized she is not alleging any wrongdoing on the part of Falls, Ayers or O??Brien. The action was based on a complaint she received that challenged the propriety of their appointments.

??Unfortunately, although these appointees were performing their duties in good faith, after investigating the issue, the District Attorney determine that under the terms of the Authority??s Article of Incorporation, which were never properly amended, the appointees did not meet the existing qualifications to sit on the Authority,? Salvantis said.
