WILKES-BARRE - Luzerne County District Attorney Stefanie Salvantis today filed a court action that challenges the appointment of three members of the county�??s Flood Protection Authority.

The complaint alleges the appointment of three board members - William Falls, Douglas Ayers and Kevin O�??Brien, was not in accordance with the Flood Authority�??s articles of incorporation and/or the county�??s charter.

In a press release, Salvantis emphasized she is not alleging any wrongdoing on the part of Falls, Ayers or O�??Brien. The action was based on a complaint she received that challenged the propriety of their appointments.

�??Unfortunately, although these appointees were performing their duties in good faith, after investigating the issue, the District Attorney determine that under the terms of the Authority�??s Article of Incorporation, which were never properly amended, the appointees did not meet the existing qualifications to sit on the Authority,�?� Salvantis said.
