Firm files suit against Pittston Lumber

A wood supply corporation in Grand Rapids, Mich., has filed suit against a Pittston lumber yard for failure to pay more than $100,000 for products and building materials.

The West Michigan-based company, Universal Forest Products Inc., is seeking payment for lumber products purchased by Pittston Lumber Co., according to records filed Monday in U.S. District Court in Scranton.

Pittston Lumber Co., with locations in Pittston and Dunmore, has been a locally owned lumber yard serving residential, commercial and remodeling contractors and architects in Northeastern Pennsylvania.

A summons was issued Tuesday to recover payment with interest on the unpaid balance, along with collection and litigation costs, including attorneys’ fees and expenses.

Invoice receipts and receivable accounting records showed the company sold $101,174 worth of lumber products and building materials to Pittston Lumber Co. from Sept. 10 through Dec. 27, 2007, according to federal court records.

In a Jan. 29 letter addressed to Mark J. Conway, of Pittston Lumber, 502 S. Blakely St., in Dunmore, Universal Forest Products Inc. requested immediate repayment in the full amount.

Conway could not be reached for comment.
