Kingston doctor is facing additional charges on case

SWOYERSVILLE – A former doctor facing charges of defrauding a man by failing to deliver a medical report was hit with additional charges Friday in connection with a second case.

David A. Rigle, 56, of Kingston, was charged with one count each of theft by deception and extortion and two counts of conspiracy for allegedly defrauding a New York man out of $15,600.

According to an arrest affidavit, Rigle, whose medical license is suspended, took money from Michael Phillips of New York under the pretense he would provide an expert opinion on whether the death of Phillips' mother death was caused by medical negligence.

Police said Phillips sent Rigle a total of seven checks, but Rigle never provided the report. At one point, Phillips questioned Rigle about why he had not gotten the report, and Rigle threatened he would destroy the medical records he had received unless Phillips sent him more money.

The charges mark the second time in three months that Rigle has been accused with defrauding a person by failing to provide a medical report.

In September, Rigle was charged with two counts of theft by deception for failing to provide a report to attorney John Solt of Hazleton, who hired Rigle to review medical records for a client.

Rigle was arraigned on the latest charges before District Judge David Barilla on Friday. He was released on $25,000 unsecured bail. He faces a preliminary hearing on Wednesday at 1:30 p.m. before District Judge Paul Roberts in Kingston.
