WILKES-BARRE – City police captured an alleged fugitive after a foot chase on Sambourne Street.

John T. Hawk, 44, of South Main Street, Wilkes-Barre, was arraigned Tuesday on charges of aggravated assault, flight to avoid apprehension, resisting arrest, providing false identification to law enforcement and disorderly conduct. He was jailed at the Luzerne County Correctional Facility for lack of $20,000 bail.

Hawk was wanted since Jan. 18, when a Luzerne County judge issued an arrest warrant alleging he failed to appear for a court hearing on a probation violation.

Court records say Hawk was sentenced in March 2010 to 24 months' probation on drug offenses.

According to the criminal complaint:

Police investigating a burglary on Sambourne Street on Monday night questioned Hawk, who used another name to identify himself.

Hawk overheard a 911 dispatcher tell the officer that there was no record on the name provided.

Hawk then ran away from the officer.

Police said Hawk crashed through a wooden gate in a yard and choked an officer during a struggle. The officer dispensed pepper spray into Hawk's face as he continued to resist arrest, the complaint says.

The officer suffered burns to his eyes and had difficulty breathing due to the pepper spray.

Hawk was apprehended when additional officers arrived to assist, police said.

A preliminary hearing is scheduled on Dec. 18.
