State court upholds awarding of Lehman contract
   
HARRISBURG The state Supreme Court upheld a Luzerne County judge’s ruling,
allowing the Lake-Lehman School District to award an electrical contract to
Main Electric Supply and Contracting Inc.
    Donald Marx of Harveys Lake and Cavanaugh Electrical Contracting Inc. of
Hanover Township filed suit in January 2002 to keep Main Electric Supply from
getting the Lake-Lehman High School addition job. Luzerne County Court of
Common Pleas Judge Michael Conahan denied the request in March 2002.
   
The Supreme Court ruling filed Monday said counsels have since agreed to
remove Cavanaugh Electrical from the lawsuit.
   
Marx argued the School District failed to adhere to bidding regulations,
which say a performance bond must be delivered within 10 days of winning a
contract. State Supreme Court Judge Renee Cohn agreed that the bond was not
issued within 10 days, but said there was evidence it would be furnished.
   
Marx also said the School District failed to investigate whether Main was a
responsible bidder. Cohn said the School District had evidence that Main could
complete the project.
