WILKES-BARRE – An Exeter man pleaded guilty Thursday to child pornography charges after police said they found numerous photos downloaded on his computer in November.
Kerry Makalusky, 39, of Orchard Street, pleaded guilty to two counts of possession of child pornography, two counts of dissemination of photos and two counts of criminal use of a communication facility before county Judge Hugh Mundy. Makalusky will be sentenced on the charges on Jan 12, 2010, and will undergo an evaluation by the Sexual Offender’s Assessment Board and may have to register for Megan’s Law.
According to court records, on Nov. 5, a Luzerne County detective received information from the Delaware County Internet Crimes Against Children Task Force that Makalusky was uploading child pornography on the Internet.
Investigators said Makalusky used the screen name and electronic mail address “Yngluvin” to upload more than 20 images of children, who appeared to be under the age of 18, exposing their genitals while in a sexual act or pose.
A week later, investigators went to Makalusky’s Orchard Street home to interview him about the incidents.
Makalusky allegedly told police that he had images of pre-teens stored on flash drives using his laptop computer to download child pornography, and that he had done it previously.
Investigators took possession of Makalusky’s computer, and found numerous images of child pornography.
WILKES-BARRE – A Nanticoke man was sentenced Thursday to two to four years in prison on several drug-related charges for the sale of heroin throughout the greater Nanticoke area.
Joshua Flaherty, 33, of East Grand Street, was sentenced on six counts of delivery of a controlled substance by county Judge Hugh Mundy. Flaherty pleaded guilty to the charges in June, and was ordered to pay nearly $700 in restitution costs.
According to court records, on Feb. 12, Flaherty sold suspected heroin to a police informant. One day later, Flaherty sold more heroin to a police informant, as well as on Feb. 14 and 15.
Police searched Flaherty’s Grand Street home on a warrant on Feb. 16, and found $350 and 39 packets of heroin, totaling 9.8 grams, under the bathroom sink.
On that day, Flaherty told police he participated in selling heroin on each occasion it was sold to a police informant and that he gave most of the proceeds of sales to a man named “Junior.” Flaherty told police he sold drugs to satisfy his heroin addiction, to pay for rent and to support his family.
SCRANTON – A federal grand jury Thursday returned a superseding indictment charging a man with using the Internet to attempt to persuade and entice a minor to engage in illegal sexual conduct, possessing child pornography and attempting to transfer obscene material to a minor.
A federal grand jury charged Lewis John Davies Jr., 41, of Scranton, for allegedly committing the offenses between April 20, 2008, and June 13, 2008.
Davies’ charges stem from an investigation by the FBI and Scranton police. He faces a mandatory 10-year prison sentence, and up to life in prison if he is convicted of the Internet enticement charge and up to 10 years in prison if convicted of either of the other charges.
Davies also faces a mandatory five years and a possible life term of supervised release after serving any prison sentence.
The indictment also seeks the forfeiture to the government of any property used and intended to be used to commit and to promote the commission of the offenses.
