WILKES-BARRE – A city man convicted of theft wants the Luzerne County Court
of Common Pleas to use time he has served for that offense to count toward a
drunken driving conviction.
   
David Casey of Wyoming Street filed papers Tuesday asking a county judge to
reduce his sentence.
    Casey pleaded guilty to two counts of driving under the influence of
alcohol in December 1998. He was sentenced to 30 days to 23 months in prison.
   
Because of an error, Casey never served his sentence, according to a court
document filed by Casey’s attorney, Mark Mack.
   
Also, Casey was arrested on theft charges and was later convicted and
sentenced in December 1999. At his sentencing, the error in the drunken
driving case was noticed.
   
He was held in jail from Oct. 6 to Oct. 29, while awaiting trial on the
theft charges, but he said he didn’t receive any credit for time served.
   
Also, Casey was admitted to the First Hospital in Wilkes-Barre on Sept. 17,
1998, and was released on Oct. 1. Court documents state he had an alcohol
dependence and tried to hang himself in his cell at the Luzerne County
Correctional Facility.
   
Casey is seeking to be credited with the time he served in prison and the
time he stayed at the hospital.
