Woman charged after allegedly kicking officer at Sherman Hills

WILKES-BARRE - A woman was arrested on charges she kicked a police officer investigating a domestic disturbance in the Sherman Hills apartment complex Wednesday night.

Cherrilyn S. Upsher, 22, of North Empire Court, was arraigned by District Judge Joseph Halesey in Hanover Township on charges of simple assault, resisting arrest and harassment. She was jailed at the Luzerne County Correctional Facility for lack of $20,000 bail.

According to the criminal complaint:

Police responded to Building 300 for a domestic dispute and encountered Robert Windley outside at about 7:40 p.m.

Windley claimed Upsher attempted to stab him with a knife, the complaint says.

Police went to Upsher’s apartment where she held the door closed. Upsher opened the door and lunged at Windley, according to the complaint.

Police alleged in the complaint Windley refused commands to calm down and jumped on a bed with a toddler. Windley continuously screamed at Windley and kicked an officer in the chest several times, the complaint says.

Police said Windley did not want to pursue charges against Upsher.
