Man charged with posting infant’s buttocks as political joke offered deal

WILKES-BARRE — Luzerne County prosecutors modified child porn charges against a Dallas Township man who admitted to uploading a picture of an infant girl’s buttocks to illustrate a political message about President Donald Trump being “an a**.”

County detectives alleged Peter Austin Frateschi, 46, also known as Dylan Roberts, uploaded the image to Facebook earlier this year.

When questioned by detectives, Frateschi explained he opened his Facebook account in 2007 under his stage name Dylan Roberts when he plays music. He claimed he uploaded the image to a post regarding Trump, explaining the image was used to demonstrate that Trump is an a**.

Frateschi said he may have been intoxicated when he uploaded the image, and he has never searched for child pornography because “that kind of stuff disgusts him.”

Frateschi’s Facebook account was suspended after the image was uploaded, court records say.

Detectives initially charged Frateschi with child pornography, dissemination of a child engaged in sex acts and criminal use of communication facility, all third-degree felonies.

Prior to a preliminary hearing Friday before District Judge Thomas Malloy in Luzerne County Central Court, Det. Chaz Balogh and Frateschi’s attorney, David Lampman, worked out a deal.

Prosecutors withdrew all the third-degree felony counts against Frateschi who, instead, faces a first-degree charge of obscene materials.

Frateschi is expected to plead guilty to the charge at a dispositional hearing scheduled on Aug. 24 before county Judge David W. Lupas.

Lampman said Frateschi will apply to participate in the accelerated rehabilitation disposition program, which is offered to first-time non-violent offenders.

Frateschi remains free on $25,000 unsecured bail.
