HANOVER TWP. — Township police arrested a man they say sexually assaulted and took pictures of a woman who became unconscious after a night of drinking earlier this year.
Police allege Mark C. Danko, 49, of Wilkes-Barre, was with two women mixing margaritas and drinking inside a residence on South Main Street on Feb. 24.
As one of the women felt sick and fell asleep, Danko allegedly assaulted her and took pictures of the acts.
According to a criminal complaint:
A woman told police she was with a relative and Danko the night of Feb. 23 and Danko was making margaritas. She consumed two drinks and was on her third margarita when she went to a bathroom and began feeling lightheaded and dizzy. When she opened the door, she fell into the arms of the other woman.
She told police she could not remember what happened after she exited the bathroom but she later woke up on a couch as Danko assaulted her.
The woman reported she was unable to move or speak as Danko moved her body onto her side. She remembered seeing flashes and believed pictures were being taken, the complaint says.
She claimed she kept losing consciousness and waking up several times as Danko allegedly assaulted her.
After the woman left the house, she told police Danko sent her a text message just after 5 a.m. Feb. 24 that stated: “… I’m really sorry I didn’t take better care of you tonight. Didn’t realize how much we were doing. Hope you had a good time thought and I REALLY hope you feel okay when you get up. Let me know if you’re okay and need anything. Love ya.”
She told her relative about the alleged assault, including seeing flashes.
When the relative confronted Danko, he told her he used his cell phone to take pictures but deleted the photographs.
Police served a search warrant at Danko’s Bowman Street residence April 3.
As Danko was reading the search warrant affidavit, he told police the affidavit is not correct and “there wasn’t any penetration.”
Danko was arraigned by District Judge Joseph Halesey in Hanover Township on two counts each of aggravated indecent assault and indecent assault, and one count each of involuntary deviate sexual intercourse and sexual assault. He was jailed at the Luzerne County Correctional Facility for lack of $75,000 bail.
