WILKES-BARRE — A Luzerne County detective has discontinued his suit against a security officer who he said falsely detained him on an accusation that he stole a candy bar from a grocery store.

Detective Chaz Balogh filed the suit through his attorney Frank Tunis in late January, in which he claimed he was “falsely, publicly, and maliciously” accused of theft by a security officer at the Aldi in Kingston.

The suit named Aldi as a defendant, in addition to Legion Security Services Inc. and security officer John Barton, who allegedly accused Balogh of stealing a candy bar “without any probable cause or reasonable belief that such theft had occurred.”

Balogh’s suit said the incident occurred on Jan. 17, 2018, claiming that Barton had compelled Balogh to submit to a search of his clothing and his person, while Balogh claimed that video evidence shows Balogh walked down the middle of the candy aisle and had no opportunity to steal the candy bar.

But Balogh’s suit was discontinued on Monday, according to court records. Attempts to reach Tunis for comment were not immediately successful Monday afternoon, so the reason for the discontinuance is not immediately clear.

The suit was dropped with prejudice, which means the suit cannot be brought again before the court.
