WILKES-BARRE — A homeowner on Carbon Lane discharged a round from a firearm when a man entered his house Sunday night, according to court records.

Police arrested James Brewington, 35, of North Sherman Street, when he returned to the house with his hands in the air at about 10 p.m.

The homeowner told police a man he never saw before pried open the screen door and entered the house, causing him to discharge a round from a firearm into the floor.

According to the criminal complaint:

Police responded to the Carbon Lane home for an attempted break-in.

The homeowner told police the man pried open a screen door that was locked and entered his residence. He repeatedly told the man to get out of his house when he discharged the handgun, the complaint says.

Police said the homeowner reported the front gate was locked and the man had to hop the fence to access the front porch. The front door was open but the screen door was locked.

Police encountered Brewington in the area of 40 Carbon Lane, where he held his hands above his head telling officers, “It was me on the front porch,” the complaint says.

The homeowner and another witness identified Brewington as the person who entered the house.

Brewington told police he consumed multiple glasses of wine starting at 8 p.m. and fell asleep. He claimed he awoke from a nightmare and was scared, leaving his residence and going to a neighbor’s house for help, the complaint says.

District Judge Rick Cronauer in Wilkes-Barre arraigned Brewington on charges of criminal trespass and loitering and prowling at night. He was jailed at the Luzerne County Correctional Facility for lack of $10,000 bail.
